Driving Law Count Down #1 Drug driving

Here is #1 of our Top 10 driving law count down. #1 Drug driving – Police can require a person to provide a saliva test in a number of situations. These include if they suspect on reasonable grounds that you were driving the vehicle on a road in the preceding 3 hours or were in charge of a vehicle (e.g. sitting in the car with the keys). A saliva test may also be conducted as a result of a random roadside intercept. The roadside drug test will detect the presence of relevant drugs including speed/ice, ecstasy and cannabis. If drugs are detected (positive test) you will be asked to provide another saliva sample for a second test at a police station or roadside testing site. If your second test is positive, your licence will be suspended for 24 hours and in some circumstances suspended until the charge is dealt with in court. The police will normally give you the notice to appear in court for drug driving. The court can, depending on your circumstance, fine you, disqualify you from driving for between 1 to 9 months or sentence you to jail.
